Japan London Homes (the “Platform”) is owned and operated by Londora Global Ltd. trading as “Japan London Homes” (“JLH”, “We”, “Us” and “Our”), a company registered in England and Wales with company number 16079137. If you wish to contact us by post, correspondence should be sent to Londora Global Ltd. 3rd Floor, 86-90 Paul Street, London, EC2A 4NE.

These terms and conditions (the "Terms") constitute a legally binding contract between you, the user, and us. Please take the time to read these Terms carefully as they explain the legal relationship between you and us and will govern your use of the Platform and the services made available through it. By accessing or using the Platform and/or any content, materials or services made available through it you are agreeing to be legally bound by these Terms.

By using this website, you agree to be bound by these Terms of Use, which fall within the exclusive jurisdiction of English courts in the case of any dispute.

We reserve the right to change these Terms from time to time in our sole discretion. Your use of the Platform will be subject to the most recent version of the Terms posted on the Platform at the time of such use. Although we recommend that you read through the Terms available on the Platform from time to time, so that you can be sure that you are aware of the latest version, we will give you reasonable prior notice if we intend to make any changes to these Terms that may be materially to your detriment before such changes take effect.

1. Use of this website

1.1. You agree that in your use of this website:
1.1.1. Any details you provide on this website are correct and dependable to the best of your knowledge (this includes all personal information, contact details and details related to property listings).
1.1.2. You will not use Japan London Homes to distribute any illegal, obscene or otherwise harmful content.
1.1.3. You will not do anything to disrupt other users’ access to the website.
1.1.4. You will not impersonate others or create fake accounts or advertisements on the website.
1.1.5. You will not use software or any other methods to gather information from the website.
1.1.6. You will not attempt to send spam or other forms of unsolicited messages to other users.
1.1.7. You will not reproduce material from the Japan London Homes website without our consent.
1.2. You need to ensure your password is kept safe and will be accountable for any activities performed by anyone accessing the website with your username and password.

2. Legal and residency requirements of landlords

2.1. You agree and warrant when you list a property on this website that:
2.1.1. You are entitled to rent out the property and doing so will not violate any law, agreement or contract, including terms related to mortgages, insurance, fire regulations, and gas and electrical safety.
2.1.2. If third-party approval is necessary (such as from a mortgage provider or freeholder) to advertise or lease the property, you have secured all required permissions.
2.1.3. If a license is needed to rent property in a specific area or to let/manage certain property types (such as Houses in Multiple Occupation), you will adhere to all licensing requirements when advertising with Japan London Homes.
2.1.4. A valid Landlord Registration Number will be included in any advertisement or tenancy document as legally required.
2.1.5. You will only upload or share photographs, videos and other information for which you have legal authorisation.
2.1.6. The property meets the Energy Performance Certificate (EPC) requirements for rental properties.
2.1.7. The property and any landlord-owned contents are adequately insured where necessary.
2.1.8. The property will have a valid Gas Safety Certificate for the duration of any tenancy arranged or facilitated through Japan London Homes, in compliance with legal requirements for landlords.
2.1.9. The property will adhere to all other legally mandated safety requirements (such as electrical safety and smoke and carbon monoxide alarms).
2.1.10. The property’s windows and doors will lock securely and properly.
2.1.11. All items provided with the property will be safe and in working condition.
2.2. You are entirely accountable for making sure the property complies with all legal requirements for landlords and properties as specified by any relevant legislation, including but not limited to the requirements mentioned in this section.
2.3. By using Japan London Homes services, landlords affirm that they comply with all relevant residency requirements (including those specified in the Landlord and Tenant Act 1987 where applicable). Landlords who use Japan London Homes rent collection or insurance services must reside in the United Kingdom.

3. Risk and Information Quality

3.1. Japan London Homes offers a platform for landlords and tenants to connect and provides features to minimize risks and administrative burdens during transactions. However, we cannot guarantee the accuracy or integrity of the information provided on this website or by its users.
3.2. Despite having measures to ensure high-quality information, Japan London Homes cannot guarantee the absolute accuracy of any information posted on this website.
3.3. You should verify the accuracy of all information and the trustworthiness of all individuals you are dealing with before entering into any contract or agreement or making any payments to them.
3.4. The material provided on this website, including content on our blog and social media accounts, is for informational purposes only and does not constitute legal advice.
3.5. We do not control, nor do we accept any responsibility or liability for, any issues that may arise from properties or tenancy arrangements provided by users of our website.

4. use of Japan London Homes advertising services

4.1. Japan London Homes advertising is intended for private landlords and should not be used for sub-letting or by third parties such as letting agents. By placing an advertisement on Japan London Homes, you confirm that you are the landlord of the property or have explicit permission from the landlord to do so.
4.2. You agree to indemnify Japan London Homes against any losses, claims, actions or proceedings that may arise from a breach of clause 4.1. Additionally, you acknowledge that Japan London Homes may take legal action or other measures at our sole discretion if you breach clause 4.1, and you will be responsible for any legal or enforcement costs reasonably incurred by Japan London Homes in connection with such a breach.
4.3. Instructions for Japan London Homes to advertise a property or perform other services are typically submitted by placing an order through the website.
4.4. Advertising prices for featured property are charged per property until it is rented out or until the landlord decides to pause or terminate their advertisement, subject to the fair usage limits specified in these Terms.
4.5. Landlords will only incur charges for services they have actively purchased or elected to use.
4.6. All advertising and other services with a fixed or maximum duration are considered continuous from the date they were initially purchased or requested through our website.
4.7. By ordering services such as advertising or referencing, users agree that Japan London Homes will begin providing the service immediately or as soon as practicable.
4.8. Since these services are intangible and irrevocable digital content, and provision begins within 14 days of placing the order, we cannot issue refunds once the service has started, except at our sole discretion.
4.9. Despite the refund policy mentioned above, landlords can end their advertising with Japan London Homes at any time after placing their advert. Instructions to cease advertising can be made through the website.
4.10. Additionally, we are dedicated to our customers and will make our best efforts to assist you if you are not fully satisfied with our paid services.

5. Advertising content

5.1. Landlords must not do any of the following:
5.1.1. Create multiple advertisements for the same room or property.
5.1.2. Create fake or misleading adverts that do not accurately represent a property currently available for rent from that landlord.
5.1.3. Include any material in their advertisements (such as photographs, videos and written content) that is inaccurate, outdated or otherwise misleading regarding the current condition of the property being advertised.
5.2. We are not responsible for the content or details of advertisements provided by users and accept no liability for such content including any errors, omissions or inaccuracies.
5.3. Advertisements must not show any discrimination against any protected characteristics as defined by the Equality Act 2010. If we identify content in an advertisement that may be in breach of these legal requirements, we reserve the right to modify or remove the relevant sections of the advertisement.
5.4. Landlords must not include any content in advertisements:
5.4.1. If they do not have the consent of the owner or any other relevant individual with rights to the content (including any individuals who appear in uploaded images).
5.4.2. If including this content would violate applicable data protection or privacy legislation.
5.4.3. If using this content would violate another party's Intellectual Property Rights.
5.5. Users agree to indemnify and reimburse us for any loss, liability, claim, damage or expense we incur due to the content they have included in an advertisement. This includes, but is not limited to, reasonable legal and court fees, and any funds reversed or charged back by the cardholder or their bank, or required to be repaid by a relevant enforcement body for consumer protection purposes.
5.6. We may modify, delete or take other actions on advertisements if we reasonably determine that such actions are necessary under these Terms, applicable law, or to improve the user experience on the Japan London Homes website. Any decision we make under this clause is final and we accept no liability to users for these decisions.
5.7. When you provide content to us for advertising, you are granting us a free, perpetual, irrevocable and non-exclusive right and license to use, reproduce, distribute, display, modify and edit that content in association with our services, and to sublicense these rights. We reserve the right, at our sole discretion, to remove or modify this content at any time without compensating you. Additionally, you confirm and warrant that you have all the necessary rights to grant us these permissions.

6. To Let boards

6.1. We may erect a "To Let" board at the property to inform potential applicants of its availability in addition to advertising a landlord's property online.
6.2. We will do this for selected properties at our discretion and do not guarantee this service for any specific property or at any specific time.
6.3. Landlords should notify Japan London Homes by email or via the contact form on our website if they have previously agreed with the freeholder or other interested parties not to erect a "To Let" board, or if they prefer not to have one placed at their property.
6.4. If a board is erected at their property, landlords agree to the following:
6.4.1. They will request the removal of the board if it is no longer wanted.
6.4.2. They will notify Japan London Homes immediately if they become aware of any damage caused or likely to be caused by the board's placement.
6.4.3. Japan London Homes is not liable for such damage (without excluding any liability that we or our subcontractors may have for boards installed negligently).

7. Referencing and Right to Rent checks

7.1. At a landlord's request, we can offer a tenant referencing service. This service is intended to assist our users in making more informed decisions, but we cannot guarantee the integrity of the information provided or the users being referenced.
7.2. Regardless of any advice given during the referencing process or otherwise, the landlord remains responsible for conducting any ID, visa or other checks required under Right to Rent legislation.

8. Certificates & Third Party services

8.1 Some Japan London Homes services, such as professional inventories or safety certificates, are provided by qualified third parties. These third parties are independent subcontractors, not employees of Japan London Homes. Consequently, Japan London Homes does not control how these subcontractors perform the services and accepts no liability for their actions.
8.2. When placing an order, customers may be asked to specify a preferred appointment date. We will strive to ensure our subcontractors complete any requested work to a satisfactory standard in a timely manner, but we cannot guarantee that the customer's preferred date will be available or that any certificate or service ordered will be completed by a specific date. We accept no liability for any losses that may occur due to a service not being delivered by a particular date.
8.3. Japan London Homes provides various third-party services, from which we earn commission, profit, or other financial incentives. These services are entirely optional, and it is always up to you whether to utilize any specific service.

9. Administration (Admin) Fees

9.1. Landlords who list their properties on our website agree not to levy any fees on tenants (or other Relevant Persons as defined under the Tenant Fees Act 2019) that would be unlawful in the region where the advertised property is situated.
9.2. Landlords who list their properties on our website agree not to levy any fees on tenants for administration or other obligatory one-time expenses, such as fees for property viewings, rental applications, referencing, inventory or tenancy setup. This policy applies regardless of whether such fees are prohibited in the region where the advertised property is situated.
9.3. Any landlord who accepts a Holding Deposit from a tenant through Japan London Homes services agrees to handle all Holding Deposits in compliance with the Tenant Fees Act 2019. This entails restricting Holding Deposits to a maximum of one week's rent, and not accepting a second or subsequent Holding Deposit for a property until all previous Holding Deposits taken have been refunded.
9.4. Landlords who list their properties on our website consent not to levy any Default Fees on tenants except for those that would be considered Permitted Payments under the Tenant Fees Act 2019.
9.5. Landlords advertising a property in England or Wales on our website agree not to request a tenancy deposit exceeding the limits specified by the Tenant Fees Act 2019.
9.6. As a best practice and to prevent confusion among prospective tenants, Japan London Homes is dedicated to ensuring that all advertisements on our website are easily comparable, regardless of the type of tenancy desired by the property's landlord. Therefore, Japan London Homes reserves the right to inform the landlord and make adjustments to any advertisements that, at our sole discretion, we deem necessary to comply with the requirements of this clause 9.
9.7. Should a landlord violate any of the terms outlined in this clause, we retain the right to suspend their account with us.

10. Fair Use policy

10.1. To safeguard all landlords using our system and the tenants inquiring, we reserve the authority to remove listings we perceive to be abusing the system. We do so to deter spam, prevent the harvesting of tenant details, and promote accurate representations of available properties in all advertisements.
10.2. Although we do not expect genuine landlords breaching our fair usage limits, we reserve the right to remove or limit any advertisements that generate an excessively high number of viewing requests or have been active for more than three months since their publication.
10.3. If we have reason to believe that a property may no longer be available for rent (for instance, if the landlord has found tenants since starting the advertisement), we reserve the right to contact the registered landlord to verify the property's availability. If the landlord does not respond within a reasonable time-frame, we may suspend the property's marketing.
10.4. We reserve the right to limit users' activities on our website (including, but not limited to, restricting the number of properties they may list) if we believe that such restrictions will enhance the security of the Japan London Homes community or reduce the exposure of our company or other users to financial or other liabilities.
10.5. To ensure properties comply with legal requirements and to protect our users, we reserve the right to suspend or remove listings and request additional documentation to verify legal ownership and/or confirm that the property has all legally required documents, such as a valid EPC.
10.6. We reserve the right to restrict the activity of users whom we believe are materially violating our terms and/or misusing the platform.
10.7. We reserve the right to cancel unconfirmed accounts or accounts that have remained inactive for an extended period, and to modify or discontinue Japan London Homes listings.
10.8. You acknowledge not to hold Japan London Homes accountable for any losses you may experience due to Japan London Homes taking any of the actions outlined in this section.

11. Customer Support and Communication

11.1. Under normal circumstances, we will strive to respond to customer support requests via email on the same working day.
11.1.1. This timeframe pertains to communication directed to the Japan London Homes customer support team and does not extend to communication with other parties, such as our subcontractors, landlords, tenants, or other users.
11.1.2. Nonetheless, there may be situations where it is not feasible to respond on the same working day, in which case we will reply at the earliest feasible opportunity.
11.2. Phone calls to Japan London Homes may be recorded for training and monitoring purposes.
11.3. If a user is unable to resolve any issues directly with the customer support team and wishes to file a complaint, they can initiate our complaints procedure by emailing Japan London Homes and indicating their intent to lodge a complaint.
11.3.1. All written complaints will be acknowledged in writing within 3 working days, and a thorough investigation will be promptly conducted by a senior staff member.
11.3.2. A formal written outcome of our investigation will be sent within 15 working days of receiving the initial complaint, except in exceptional circumstances where reasonable extensions to this timeframe are necessary to fully investigate the complaint.
11.3.3. If we are unable to satisfactorily resolve your complaint, you can request an independent review from Property Redress Scheme (PRS). Their contact details are: Limelight, 1st Floor, Studio 3, Elstree Way, Borehamwood, Hertfordshire, WD6 1JH; 03333 219 418; info@propertyredress.co.uk.
11.3.4. PRS requires that all complaints be addressed through an in-house complaints procedure before being submitted for an independent review. Referral to PRS must occur within 12 months of our final viewpoint letter.
11.3.5. If, after adjudication by PRS, a user believes their complaint has not been satisfactorily addressed by Japan London Homes or PRS, they may be able to file a further complaint with Propertymark by downloading a complaint form from the Propertymark website.
11.4. If a user is dissatisfied with Japan London Homes' provision of a regulated financial product and expresses this dissatisfaction, the following procedures will apply:
11.4.1. Within 3 working days, Japan London Homes will provide a written summary of our understanding of the complaint and the steps taken to address the issue.
11.4.2. If the complaint cannot be resolved within 3 working days, a thorough investigation will be conducted, and a formal written response will be provided within 8 weeks. This response will include information about the user's right to appeal to the Financial Ombudsman Service, where applicable.

12. Offer and Acceptance of Holding Deposits in England and Wales

12.1. When a tenant uses the Making Offer feature, they will be required to pay a Holding Deposit equivalent to one week's rent to initiate the process (‘the Offer’).
12.2. The landlord will be notified immediately and has full discretion to either reject the Offer, request further steps (including but not limited to referencing or verifying the tenant's right to rent), or ask the tenant to sign the Tenancy Agreement. If the tenant adds additional tenants or guarantors to the application, or requests the landlord to do so, it is understood that each new party will cooperate with the application process in the same manner as the tenant.
12.3. If the landlord rejects the Offer or does not proceed within 96 hours of the Offer being made, the Holding Deposit will be refunded to the tenant.
12.4. If the landlord decides to proceed with the tenant’s application following the Offer, the property will be marked as Under Offer and will no longer appear as Available in searches on Japan London Homes while the tenant's application is active.
12.5. To clarify, if the landlord proceeds with the application following the Offer, this action alone does not create an Assured Shorthold Tenancy or any other Tenancy Agreement.
12.6. Once the Offer has been made, the landlord has the option to order referencing through Japan London Homes. Any referencing recommendation provided concerning the applicant's suitability is for informational purposes only and is not binding on either party.
12.7. By making the offer, the tenant agrees to the following:
12.7.1. The tenancy will commence on the date specified by the tenant during their application, unless a different date is agreed upon in writing with the landlord.
12.7.2. If the landlord and tenant enter into a tenancy agreement for the Property, the Holding Deposit (if applicable in England or Wales) will be applied towards the first rent payment under the tenancy.
12.7.3. The tenant will accept the property ‘as seen,’ unless otherwise agreed in writing with the landlord.
12.7.4. The tenant will sign our standard contract, a sample of which is available on our website, unless specific additional clauses or amendments have been explicitly agreed upon in writing with the landlord prior to their inclusion in the contract.
12.7.5. In England and Wales, the government's How to Rent Guide and other relevant documents will be emailed to the tenant's registered email address.
12.7.6. The deadline for finalizing the tenancy agreement will be determined based on the specific requirements of the tenancy and the preferences of both the landlord and the prospective tenant. Japan London Homes will retain the Holding Deposit only as long as necessary to satisfactorily finalize the tenancy agreement between the parties.
12.8. If the landlord decides not to enter into a tenancy agreement for the Property through the Making Offer process in England or Wales, the Holding Deposit will be returned to the tenant, subject to relevant legislative requirements, unless one or more of the following applies:
12.8.1. After the landlord decided to proceed following the Offer, the tenant informed the landlord or Japan London Homes in writing that they no longer wished to continue their application to rent the property.
12.8.2. The tenant provided materially false or misleading information to the landlord or Japan London Homes. Any information shared with third parties used by Japan London Homes during the referencing process will be accessible to both Japan London Homes and the landlord. The tenant understands that providing materially false or misleading information to these third parties can result in the Holding Deposit not being refunded.
12.8.3. The landlord made reasonable efforts to enter into a tenancy agreement, but the tenant did not take corresponding reasonable steps to finalise the agreement.
12.8.4. The landlord is prohibited by section 22 of the Immigration Act 2014 (persons disqualified by immigration status) from granting a tenancy to the tenant, and the landlord was unaware, and could not reasonably have been expected to be aware, of this prohibition before accepting the Holding Deposit.
12.9. If the tenant withdraws from the application (or we have reason to believe this might happen), we reserve the right to resume marketing the property until it is confirmed that the tenant still intends to proceed.
12.10. If one or more conditions for retaining the Holding Deposit, as specified in these Terms and relevant legislation, are met, Japan London Homes may, when appropriate, transfer the Holding Deposit to the landlord as compensation for the tenant's abandoned application and any related costs or lost profits. However, landlords using the Japan London Homes website agree that the decision to pay the Holding Deposit (or any portion of it) to the landlord rests solely with Japan London Homes, and this decision is final and not open to discussion.
12.11. When Japan London Homes forfeits a holding deposit to a landlord based on the evidence provided by the landlord in support of the claim, the landlord agrees to:
12.11.1. Repay the holding deposit in full to Japan London Homes if any relevant enforcement body (including but not limited to the courts, The Property Ombudsman, or Trading Standards) instructs Japan London Homes to return the funds to the tenant, or if the funds are returned to the tenant by their bank.
12.11.2. Indemnify Japan London Homes against any loss, claims, actions, or proceedings that may arise as a result of Japan London Homes retaining the holding deposit.
12.12. The Making Offer service cannot be used if a tenant has already paid a holding deposit directly to the landlord for the property. By making an Offer, tenants declare that they have not previously paid a holding deposit for the property, or if they have, that it has been fully refunded.
12.13. If funds have been paid to Japan London Homes for a Making Offer tenancy application but the requirements of the Making Offer service are not fulfilled, Japan London Homes will, at our sole discretion, decide whether to return the Holding Deposit and any other related funds to the tenant or to pay some or all of these funds to the landlord.

13. Tenancy Agreements

13.1. Any acceptance by the landlord of a tenant’s Offer (as outlined under the sections "Under Offer" and "Acceptance of Holding Deposits") should be considered subject to contract. To finalise the tenancy using our Making Offer service, the Tenancy Agreement must be signed digitally on the Japan London Homes website.
13.2. Japan London Homes acts as a trusted, impartial third party in relation to all documents completed through the service.
13.3. Consequently, Japan London Homes disclaims any representations of any kind regarding the documents processed via the service.
13.4. You are responsible for identifying the parties involved in all transactions you complete using the service and for evaluating all associated risks.

14. Tenancy Deposits

14.1. For tenancies created via the Making Offer feature, Japan London Homes will collect the Deposit and register it with our partner Deposit agency to ensure it is protected under the government-backed tenancy deposit scheme. The Deposit will be held according to the terms and conditions of the Deposit agency, and these terms will be provided to both the landlord and the tenants as part of the Deposit registration process.
14.2. Where the Deposit is held by Japan London Homes under an insured scheme, the following conditions will apply:
14.2.1. The Deposit funds will be held by Japan London Homes in a designated client account.
14.2.2. Japan London Homes will retain any interest earned on the Deposit funds held in the client account.
14.2.3. The landlord must inform Japan London Homes through the Japan London Homes platform in the following situations:
  • 14.2.3.1. The tenancy ends.
  • 14.2.3.2. A renewal contract is signed.
  • 14.2.3.3. One or more joint tenants have left or been replaced.
  • 14.2.3.4. The property has been sold with tenants in place.
14.2.4. The landlord agrees to indemnify Japan London Homes for any reasonable losses incurred due to the Deposit being incorrectly handled as a result of the landlord's failure to comply with section 14.2.3.
14.2.5. At the end of the tenancy, the tenant must request the return of the Deposit directly through the Japan London Homes platform. The landlord must submit any claims to retain all or part of the Deposit through the same platform. Japan London Homes will allocate the funds in accordance with these Terms and the terms of the deposit scheme.
14.2.6. Japan London Homes will only accept claims by the landlord to retain any portion of the Deposit if these claims are submitted directly through the Japan London Homes platform within 10 days of the tenancy's end.
14.2.7. Only evidence submitted to Japan London Homes through the Japan London Homes platform will be considered. Japan London Homes reserves the right to return part or all of the Deposit to the tenant if the landlord fails to provide sufficient evidence.
14.2.8. Any amount claimed by the landlord from the Deposit that is disputed by the tenant within the timescales permitted by the deposit scheme will be transferred to the scheme. The dispute will then be resolved according to the scheme's dispute resolution process.
14.2.9. If the landlord submits a claim for all or part of the Deposit through the Japan London Homes portal and the tenant does not respond within a reasonable timeframe, Japan London Homes reserves the right to transfer the claimed Deposit amount to the landlord.
14.2.10. Japan London Homes reserves the right, at its sole discretion, to consider only the evidence submitted by the landlord or tenant that has been uploaded to the Japan London Homes platform.
14.2.11. If the landlord does not request to retain part or all of the Deposit through the Japan London Homes portal within 10 days of the end of the tenancy, Japan London Homes may, at its sole discretion, return the full Deposit amount to the tenant.
14.2.12. The landlord will not hold Japan London Homes responsible if they fail to contact Japan London Homes directly through the Japan London Homes platform within 10 days of the tenancy ending and later decide to retain part or all of the Deposit.
14.2.13. Japan London Homes will not be held liable if the tenant fails to directly contact Japan London Homes through the Japan London Homes platform within 10 days of the tenancy ending and later wishes to dispute the amount of the Deposit retained by the landlord.
14.2.14. Should the tenant directly raise a dispute with the deposit scheme, Japan London Homes will transfer any pertinent Deposit funds held to the deposit scheme for adjudication.
14.2.15. If the deposit scheme or another relevant authority instructs Japan London Homes to return an amount of the Deposit that was previously paid to the landlord, the landlord agrees to reimburse Japan London Homes the specified amount within 14 days of receiving a written request. Additionally, the landlord agrees to indemnify Japan London Homes against any reasonable losses incurred.
14.2.16. Landlords will be responsible for any additional fees incurred in handling Deposit disputes related to tenancies that are not Assured Shorthold Tenancies.
14.2.17. When determining how the Deposit is to be handled, Japan London Homes reserves the right to only accept instructions and evidence submitted through the Japan London Homes platform.
14.2.18. Communications from the lead tenant to Japan London Homes are made on behalf of all tenants. Any decision by the lead tenant to agree to an amount of the Deposit being retained by the landlord is binding on all tenants.
14.2.19. The lead tenant must nominate a bank account on behalf of all tenants for the return of any Deposit funds at the end of the tenancy and provide a forwarding address.
14.2.20. If a tenant exits a joint tenancy, the joint tenant must inform Japan London Homes and request any amount due to them from the Deposit. Tenants cannot hold Japan London Homes responsible for any funds returned to the lead tenant for that tenancy.

15. First payments of Rent

15.1. Japan London Homes will also handle the first rent payment for the tenancy. If the tenant is required to pay both rent and deposit to Japan London Homes, the payments will be applied to the rent first. Once the rent is fully paid, any additional funds will go towards the deposit. The initial rent payment will be held by Japan London Homes until the tenant has moved into the property, for a maximum of 14 days from the start of the tenancy term or from the date when full payment for rent and deposit is received, whichever is later. After this period, the rent will be transferred to the landlord, subject to any conditions below.
15.2. The landlord must provide Japan London Homes with UK bank account details and a valid account ID for the Deposit agency used for the tenancy. Until these items are fully received, the Making Offer process cannot be completed. We reserve the right to make all reasonable decisions regarding the handling of such funds, including holding the first month's rent payment until the required details are provided in full.
15.3. Any outstanding fees owed to Japan London Homes will be deducted from the first month’s rent before it is transferred to the landlord, where applicable (for instance, if the landlord has not pre-paid for using the Making Offer service).
15.4. Subsequent rent installments will be paid by the tenant when due according to the tenancy agreement, subject to the following conditions:
15.4.1. The tenant will make these payments to Japan London Homes, unless the landlord notifies Japan London Homes and the tenant that they wish the rent to be paid to a different bank account.
15.4.2. Once received by Japan London Homes, rent payments for each month will be transferred to the bank account nominated by the landlord.
15.4.3. Japan London Homes will endeavor to transfer the payment to the landlord on the same working day it is received (except for the first month’s rent at the start of the tenancy, as outlined in clause 15.1 above). However, Japan London Homes cannot guarantee that a payment will be made on or by a particular date in all circumstances.
15.4.4. Japan London Homes will not charge the tenant for this rent collection service.
15.4.5. If the landlord has an outstanding balance with Japan London Homes (such as for monthly subscription services), this amount will be deducted from the rent before it is transferred to the landlord.
15.4.6. Should the landlord prefer rent payments to be made to a different bank account rather than being collected by Japan London Homes, they can update their preferences via the Japan London Homes dashboard and inform both Japan London Homes and the tenant.
15.4.7. Payments can only be made by Japan London Homes to a valid UK-based bank account that is uniquely identifiable by its sort code and account number.
15.5. Japan London Homes will make every effort to operate this service effectively. However, neither Japan London Homes nor its affiliates, officers, directors, agents, subcontractors, or employees will be liable to you or any third party for any liabilities, damages, or losses (whether direct, indirect, consequential, special, or otherwise) incurred or suffered in connection with the use of this service, whether in contract, tort (including negligence), or otherwise.
15.6. If Japan London Homes mistakenly transfers any funds to your account, you agree to repay the full amount to Japan London Homes as soon as practically possible. This includes any overpayment where the amount transferred exceeds the sum properly due.
15.7. If Japan London Homes is unable to transfer rent payments to the landlord's nominated bank account due to the payments bouncing back, the landlord agrees that after six unsuccessful attempts, the rent payments will be returned to the respective tenants. The landlord further agrees not to hold Japan London Homes responsible for the rental amounts.
15.8. We use a tool provided by TrueLayer Limited (www.truelayer.com) ("TrueLayer") to initiate payments from your payment account. When you instruct a payment via our app using TrueLayer, TrueLayer's terms of service ("Terms of Service") will apply to the payment initiation. The Terms of Service set out the terms on which you agree to TrueLayer initiating payment from your payment account. TrueLayer is subject to UK and EU data protection laws and is required to treat your data in accordance with those laws, as well as the Terms of Service and TrueLayer's Privacy Policy. TrueLayer is authorised by the UK Financial Conduct Authority under the Payment Services Regulations 2017 to provide account information services and payment initiation services (Firm Reference Number: 793171).

16. Handling of Personal Data

16.1 Japan London Homes will be the controller of the User's personal information in our possession. In the course of providing our services, we may transfer your personal information to another user. 16.2.
16.2 The transferred User acknowledges that by receiving this data, he/she becomes the controller of the personal data provided by Japan London Homes. That user agrees to fulfill the compliance obligations stipulated in the relevant data protection laws.
16.3. Specifically, you must ensure that you process user personal data only when you have a lawful basis for doing so, and you must fully accept your compliance responsibilities.

17. Legal Disclaimer on Use of Japan London Homes

17.1. We are not liable for any consequences or losses resulting from your use of this website. You expressly understand and agree that Japan London Homes shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential, or exemplary damages of any kind. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Japan London Homes has been advised of the possibility of such damages). This limitation of liability includes damages arising from: (i) any document or transaction sent through the service; (ii) the use or inability to use the service, including errors, interruptions, or delays; (iii) unauthorized access to or alteration of your documents or transmissions; or (iv) any other matter relating to services ordered from Japan London Homes.
17.2. Except as provided elsewhere in these Terms and Conditions, to the fullest extent permitted by law, we (including our affiliates, officers, directors, agents, subcontractors and employees) will not be liable to you in contract, tort (including negligence) or otherwise for any liabilities, damages or losses (whether direct, indirect, consequential, special or otherwise) incurred or suffered by you or any third party in connection with this website or any services ordered or delivered through it. This limitation of liability includes issues arising from the use, inability to use, or the results of using this website, any linked websites, and any materials posted on it.
17.3. Notwithstanding the above clauses, nothing in these Terms and Conditions shall limit or exclude Japan London Homes' liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
17.4. If any provision or part of these Terms and Conditions is deemed invalid or unenforceable by a court, regulator or other relevant authority, that specific provision or part will be removed as required, and the rest of the Terms will remain in effect and enforceable.

18. Licensing and Redress Schemes

18.1. Japan London Homes is a Member of Property Redress Scheme and subscribes to this scheme's Code of Practice for Letting Agents. Further details of the scheme can be found at https://www.propertyredress.co.uk.
18.2. Users can request an electronic copy of the relevant codes of practice for any schemes in which we are members.
18.3. Japan London Homes maintains Professional Indemnity Insurance and Client Money Protection through accredited providers in accordance with the relevant schemes and legislation for letting agents. Additional information is available upon request.
18.4. Client Money Protection insurance of Japan London Homes is provided by Propertymark Client Money Protection.
